Tastewise – GenAI Policy

Some of the Services offered by Tastewise as part of our Online Terms of Service or Master Services Agreement (“Terms”), may include generative artificial intelligence features. The use of such features is subject to the Terms and to these terms of Generative AI Features (“GenAI Policy”). Please read these carefully to understand what you can and cannot do with our Service.

Any capitalized term not defined herein shall have the meaning ascribed to it in the Terms.

  1. Content rights

Some features of the Service allow you to submit certain information, text, graphics, videos, or other material (“Content”) for the purpose of processing such Content through machine learning models provided by us or by third parties. 

You are responsible for Content that you submit on or through Service, including its legality, reliability, and appropriateness. You represent and warrant that: (i) You own the Content and/or you have the right to use it and the right to grant us the rights and license as provided in the Terms and this GenAI Policy, and (ii) the Content on or through Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the account if the foregoing representations are breached. You retain any and all of your rights to any Content you submit through Service. We take no responsibility and assume no liability for Content you or any third party submits through the Service. By submitting Content using the Service You grant us the right and license to use, modify, reproduce, and distribute such Content on and through the Service. Certain features of the Service may generate output based on the Content you provide to the Service (“Output”). You acknowledge and consent that Content may be transmitted to and processed by third-party service providers as necessary to provide the Service, provided that Tastewise ensures such parties are subject to appropriate confidentiality, security, and data protection obligations. Subject to your compliance with the Terms and this GenAI Policy, we hereby assign to You all of our right, title and interest in and to Output, to the extent available to Us. We may use Content or Output to provide and maintain the Service, comply with applicable law, and enforce our policies. You are responsible for any Content, including for ensuring that it does not violate any applicable law, third party rights, the Terms or this GenAI Policy, and for your use of the output. Due to the nature of machine learning, users that provide similar Content may result in the Service generating the same or similar output for you or a third party. Even if the same, output that is requested by and generated for other users is not considered your “Output.” We take no responsibility and assume no liability for Output provided through the Service.

  1. Use restrictions

You may not use the Services to develop machine learning models or related technology. You must use the Services responsibly and in compliance with applicable laws. You agree not to input personal or sensitive information, including names, phone numbers, addresses, email addresses, or dates of birth.

You must not use the Services or any Output to: (i) perform, promote, or facilitate illegal, harmful, or malicious activities, or exploit or harm minors; (ii) generate or distribute content intended to misinform, misrepresent, or mislead, including impersonation, deceptive claims of authorship or expertise, or automated decision-making in areas that materially affect individuals’ rights or well-being (such as finance, legal matters, employment, healthcare, housing, insurance, or social services); (iii) generate sexually explicit content intended for pornography or sexual gratification, except for legitimate scientific, educational, documentary, or artistic purposes; (iv) promote violence, terrorism, extremism, harassment, or abuse; (v) generate content that encourages self-harm or discrimination; (vi) collect, disclose, or misuse personal information without authorization; or (vii) attempt to bypass, override, or interfere with the Services’ safety, security, or access controls. 

For avoidance of any doubt, customer provided data is not used to train any AI models.

The Services use experimental technology and may sometimes provide inaccurate or offensive content that is not actively provided by Tastewise nor is endorsed by Tastewise. Use discretion before relying on, publishing, or otherwise using content provided by the Services. Do not rely on the Services for medical, legal, financial, or other professional advice.
